Who we are
Kariega Web Studio is the trading name of Simpiwe Sobici, a sole proprietor based in Kariega, Eastern Cape, South Africa. These terms apply when you buy a website, care plan or other service from us. In them, "we" and "us" means Kariega Web Studio, and "you" means you or your business.
What we do
We design, build and host static websites: fast, secure sites of a few pages that tell people about your business and how to reach you. We don't build online shops, booking systems, web apps or sites you edit yourself through a content management system. Our pricing page lists exactly what each bundle and service includes.
Quotes and payment
- Before we start, we confirm your bundle or quote and the price in writing, by email or WhatsApp.
- The build fee is paid upfront, before we start work. Your 30-day money-back guarantee protects it (see below).
- Your care plan (or hosting) is paid monthly from the month your website goes live, by EFT or debit order.
- Our launch offer of 10% off every bundle has no end date. If we ever end it, we'll say so on our website first, and it won't change a price we've already confirmed with you.
- Anything outside your bundle or care plan, we'll quote upfront. We won't charge you for extra work you haven't agreed to.
Building your website
- You supply the content: your text, photos, logo and business details. We'll send you a checklist of what we need.
- You confirm that you have the right to use everything you send us, and that it's accurate and lawful.
- Most websites go live within 30 days of our first call. That depends on getting your content and feedback in good time, so if those are delayed, launch may be too.
- We show you the design before launch, and we'll make reasonable changes until you're happy with it.
30-day money-back guarantee
If you're not happy with your website, tell us within 30 days of it going live and we'll refund your build fee and every care or hosting fee you've paid. We'll ask what went wrong so we can do better, but we won't argue.
When we refund you:
- we take the website offline, and its design and code stay with us;
- your domain, text, photos and logo are still yours, and we'll help you move your domain to an account you control.
After the 30 days, the guarantee ends. You can still cancel your care plan at any time (see "Cancelling").
Who owns what
- Your content and domain are always yours: your text, photos, logo, business details and domain name.
- The website's design and code become yours 30 days after launch, once the money-back guarantee has ended and all your payments have cleared. We then both sign a written assignment that transfers them to you, as the Copyright Act requires.
- Until then, the design and code belong to us, and you have the right to use them for your website while we host it.
- We may show your website in our portfolio unless you ask us not to. By default, your site has a small "Website by Kariega Web Studio" credit in the footer, which you can ask us to remove.
Domains
- A free .co.za domain comes with hosting: any care plan or our hosting option. We don't sell domains on their own.
- We register it in your name, so you're the legal holder.
- We renew .co.za domains we registered for you for free every year while we host your website. If you bring your own domain, renewing it stays your responsibility.
- If you leave, we'll move the domain to an account you control, and renewing it becomes your responsibility.
Care plans and hosting
- Care plans, hosting and content changes are only for websites we built. If your website was built by someone else, get in touch and we'll look at it case by case.
- Your care plan includes the monthly content changes shown on our pricing page. Bigger changes, or more than your monthly allowance, we'll quote upfront.
- We aim to keep your website online and secure, but no website can be online 100% of the time. If something goes wrong on our side, we'll fix it as quickly as we can.
Cancelling
- There's no contract. You can cancel your care plan or hosting at any time with one month's notice.
- If you cancel after the money-back guarantee has ended, we'll give you your website files and the signed assignment, so you can host your site anywhere, and we'll move your domain to you.
- If you cancel within the first 30 days, you can ask for a refund under the money-back guarantee instead.
- If monthly payments stop and stay unpaid for a month after we've reminded you, we may take the website offline until they're paid up.
Our responsibility to you
We'll do our work with reasonable care and skill. As far as the law allows, we're not responsible for indirect losses such as lost sales or profits, and our total responsibility to you is limited to the fees you've paid us in the 12 months before the problem happened. Nothing in these terms takes away your rights under the Consumer Protection Act or any other law that protects you.
Your personal information
We handle your personal information as described in our privacy policy.
Changes to these terms
If we change these terms, we'll update this page and the date at the top. Changes won't apply to work or prices we've already confirmed with you unless you agree.
